Specific services are governed by written proposals, contracts, or service agreements executed between Company and Client.
3. Website Use

- Monitoring may be performed by third-party central stations.
- Signal transmission depends on telecommunications infrastructure not controlled by Company.
- Dispatch decisions are based solely on signals received and verification protocols.
Company is not an insurer. Clients are responsible for maintaining adequate property and liability insurance coverage.
6. Client Responsibilities
Clients agree to:
- Provide accurate site and operational information
- Maintain equipment and infrastructure
- Maintain internet and power connectivity (if required)
- Update contact lists for monitoring services
- Pay invoices according to agreed terms
Failure to maintain systems may impact performance and warranties.
7. Warranty & Workmanship
Equipment warranties are subject to manufacturer terms.
NERSA may provide limited workmanship warranties as defined in individual agreements.
Warranties do not cover:
- Misuse
- Unauthorized modification
- Acts of nature
- Vandalism
- Power surges
- Network failure
All warranty details are governed by executed contracts.
8. Limitation of Liability
To the maximum extent permitted by law:
Company’s liability for any claim arising from services or equipment shall be limited to the lesser of:
- The amount paid by Client for services within the previous twelve (12) months, or
- $10,000
Company shall not be liable for:
- Indirect damages
- Consequential damages
- Lost profits
- Business interruption
- Special or incidental damages
This limitation applies regardless of cause, including ordinary negligence.
9. Indemnification
Client agrees to indemnify and hold harmless Northeast Remote Surveillance and Alarm, LLC, its employees, contractors, and affiliates from claims arising from:
- Client misuse of systems
- Failure to maintain equipment
- Unauthorized system alterations
- Third-party claims related to installed equipment
10. Payment Terms
Payment terms are defined in executed proposals or service agreements.
Failure to pay may result in:
- Suspension of services
- Termination of monitoring
- Collection proceedings
Client agrees to pay reasonable collection costs and legal fees where applicable.
11. Governing Law
These Terms shall be governed by and interpreted under the laws of the Commonwealth of Pennsylvania.
Any disputes shall be resolved within the jurisdiction of Pennsylvania unless otherwise agreed in writing.
